Stake Energy Pty Ltd - Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY PARTICIPATING IN STAKE ENERGY SERVICES, YOU AGREE TO BE BOUND BY THE TERMS BELOW.

If you do not agree to these Terms, you may not participate in Stake Energy’s services.

1. Scope of Services

Stake Energy Pty Ltd ("Stake Energy", "we", "us", or "our") provides residential battery storage systems at no upfront cost. Our services include:

Installation of battery systems at your premises.

Management of battery charging and discharging through proprietary algorithms.

Access to the Stake Energy mobile application for monitoring savings and accessing additional rewards.

2. Eligibility

Participation is available to residential customers located in areas where Stake Energy operates. Stake Energy reserves the right to refuse service at our sole discretion.

3. Battery Ownership and Access

3.1 Ownership
All installed batteries remain the property of Stake Energy.

3.2 Access
You must provide Stake Energy with reasonable access to the battery for maintenance, inspection, repair, replacement or removal.

3.3 Restrictions
You may not modify, interfere with or attempt to control the battery or its operation.

4. Costs, Fees, and Rebates

4.1 Battery Rental Fee
You agree to pay a monthly battery usage fee as outlined in the Stake Energy Pricing Schedule.

4.2 Annual Rebate
Details of rebates and backup power options are provided in the Stake Energy Pricing Schedule.

5. Battery Removal and Termination

5.1 Voluntary Termination
You may terminate your participation at any time with 30 days' written notice.

5.2 Removal Fees

Removal fees applicable upon termination are set out in the Stake Energy Pricing Schedule.

6. Backup Power Option

6.1 Backup Power Availability
Backup power functionality is available for select appliances upon request.

6.2 Rebate Waiver
If you select backup power, you will not receive an annual rebate for the battery providing backup functionality.

7. Customer Responsibilities

You agree to:

Maintain your premises to ensure the safety and accessibility of the battery system.

Notify Stake Energy of any relocation, property sale, or significant renovations.

Use the Stake Energy app and services in compliance with applicable guidelines and policies.

8. Service Monitoring and Interruptions

8.1 Monitoring
Stake Energy remotely monitors battery performance and will notify you of any required actions.

8.2 Outages
Backup power is only available if specifically requested and installed. Non-backed-up systems will lose power during outages.

9. Safety and Standards

Stake Energy uses Clean Energy Council approved batteries and Solar Accreditation Australia certified installers. Batteries are installed according to Australian safety standards.

10. Disclaimer of Warranties

Stake Energy provides services "as is" and "as available." To the maximum extent permitted by law, Stake Energy disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law:

Stake Energy is not liable for indirect, incidental, special, consequential, or punitive damages.

Stake Energy’s total liability is limited to resupplying the services or refunding amounts paid by you.

12. Privacy

Your personal information is handled according to our Privacy Policy. By participating in Stake Energy’s services, you consent to the collection, use, and disclosure of your information as described therein.

13. Changes to Terms

Stake Energy may modify these Terms at any time. Updated Terms will be posted on our website and notified to you with at least 10 days’ notice. Continued use of the services after such changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts located in New South Wales, Australia for any disputes.
